Informative Emails

It is communicated that, by the one Resolution of the Special Commissioner for the Reconstruction and Repair of Damage Caused by DANA, implementing the eleventh and eleventh bis of Order TMD/101/2025, of 31 January, as amended by Order TMD/1586/2025 regarding the standard models for the submission of projects by beneficiary entitiesthe updated models are approved in line with the modification of WTO/101/2025 by WTO/1586/2025. Therefore, they are attached in this email:

-The Resolution of the Special Commissioner for the Reconstruction and Repair of Damage Caused by DANA, which develops the eleventh and eleventh bis of Order TMD/101/2025, of 31 January, modified by Order TMD/1586/2025 regarding the standardized models for the submission of projects by the beneficiary entities.

-Valued Memory Model (unique).

-Certification accrediting the ownership of the good and of the public use or service (direct and indirect management).

-Responsible declaration of the entity managing the service (indirectly managing), with all the aid, subsidies, income or resources that it has requested or obtained from any Administration, agency or public or private entity, national or international, for the repair, restitution or reconstruction of the infrastructures, equipment or facilities that it manages in that municipality.

-(Award phase) Intervention report indicative of the unique and invariable code attributed to the project of expenditure throughout its life (in the terms established in the Local IC of application).

We also take advantage of this communication, to provide you with the following documents:

-Manual of use of AlbaDana for Beneficiary entities.

In relation to the AlbaDana User Manual, on the award phase, it is remembered that in the Section: 6. Award of projects, From the aforementioned manual, it is explained in detail the data and how they should be uploaded to AlbaDana, as the necessary documentation. In addition, the following indications are indicated:

-A single form will be sent for each project. That is, the award form will provide information on all awarded contracts relating to the project in the file.

-Regarding the deadline for submission of the award formas stipulated in paragraph 15 of WTO/101/2025 as amended by WTO/1586/2025 (extended by DGCAL Resolution dated 7/10/2025): Within the maximum period of the twelve months After the acceptance of the project by the Commissioner, the beneficiary entities will communicate through the application “ALBA-DANA2024” the list of contracts or work orders through which they will execute the project.

In the event that an extension of that time limit is necessary presentation of the award form, as reflected in point 2a of paragraph Eighteenth of that order, before the deadline, refer to DIR EA0056568 - Office for Coordination and Promotion of the Execution of Aid (belonging to Commissioner DANA), through the General Electronic Register, job with motivated request for an extension which may be a maximum of 6 months.

In the section 6.1.2. Contracts/orders, of the Manual, indicates, on page 18, how to copy and paste, the link to the publication of the tender in PLACSP.

Regarding the Section Fifth bis. Assistance in the form of technical assistance to beneficiary entitiess OTMD/101/2025 of 31 January, as amended by OTMD/1586/2025 of 29 December and taking into account the D.F. 1st of Royal Decree-Law 5/2026, of 17 February, adopting urgent measures in response to the damage caused by various adverse meteorological phenomena, particularly in the autonomous communities of Andalusia and Extremadura.

Currently, the Commissioner is finalizing the creation of a specific project within the AlbaDana application aimed exclusively at the management and registration of the amount corresponding to the technical assistance provided in section Fifth bis of Order TMD/101/2025.

This new project will allow beneficiary entities to:

• Correctly impute the expense associated with technical assistance.

• Record the request and the required documentation through the standardized models.

• Integrate the information in the usual circuit of processing and justification of AlbaDana

As soon as it is available, you will be informed and attached the AlbaDana manual, updated in relation to this new project. However, the standard models are advanced as the operating guidelines of this specific assistance project.

A) Standardized models:

Through the Resolution of the Special Commissioner for the Reconstruction and Repair of Damage Caused by DANA, implementing the fifth bis paragraph of Order TMD/101/2025 of 31 January, as amended by Order TMD/1586/2025 as regards standard models for the submission of projects by entities benefiting from assistance. The models for the assistance project are approved, therefore, attached in this email:

-The aforementioned Resolution.

-Application Model of the entity benefiting from the assistance aid.

-Model of Report Justified intervention of the expenses of assistance.

B) Operating Guidelines for the Assistance Project:

1. AMOUNT:

The amount that the beneficiary may devote to the technical assistance project will be subject to the following limits:

-Under no circumstances may it exceed 3.5% of the eligible expenses that have been duly justified in all the projects submitted by the entity.

-This amount must be included in the grant granted, without being able to generate a further increase in the aid granted.

-Consequently, the maximum admissible amount will be the smallest among:

o 3.5% of eligible expenses finally justified, and

o The total amount of the grant awarded.

2. TIME FRAME: The submission of this project will be within the same time frame as the other regular projects. In particular, as indicated in point 2 of the Section 10. Deadline and form of submission of projects, OTMD/101/2025 as amended by OTMD/1586/2025: Projects can be submitted until 3 p.m. on 5 July 2026.

3. ELIGIBLE EXPENSE

Eligible expenses within the technical assistance project will be those directly linked to the preparation, management, monitoring, control and justification of projects financed under Order TMD/101/2025. In particular, the following types of expenditure may be charged::

(a) External service contracts

Expenses arising from the contracting of professional services necessary for technical assistance will be eligible, such as:

·technical support in project development,

·assistance in administrative or economic management,

·Specialized consulting,

·Support in documentary or technical justification.

These expenses must be charged:

-preferably to Chapter 2 the budget (current expenditure on goods and services),

-exceptionally to Chapter 6where the nature of the service involves an investment or supply associated with a service contract with an investor component.

b) Commissions to own media personified.

The costs arising from orders made may be charged to their own resources, provided that:

-the order is formalized in accordance with the applicable regulations,

-the purpose of the order is directly related to technical assistance tasks,

-The cost is determined according to the system of tariffs or cost structure approved for the own medium.

(c) Specifically seconded or contracted municipal staff

Personnel expenses will be eligible when:

- they are municipal personnel specifically assigned to technical assistance tasks, or

-Additional personnel have been hired for the execution of these tasks, always within the applicable regulatory framework.

These expenses will be charged to:

-Chapter 1 of the budget (staff costs). It will be admitted, among others: wage remuneration and social contributions.

In all cases, the actual and effective involvement of the staff in the technical assistance tasks must be demonstrated by means of reports, working parties, secondment resolutions or equivalent documentation.

-As an example, an indicative model of secondment of municipal staff is attached.

4.CALCULATION OF THE PRESENTATION AMOUNT, by the entity: As the assistance project must be submitted before the end of the period indicated in the second point. It is suggested that once all the projects of the entity have been presented, at that time, the entity will know the total amount allocated and presented, with which it will be able to estimate the amount it could obtain for the assistance (to take into account the limits commented, 3.5% on the eligible expenses that would have been duly justified - at that time it is estimated - and 3.5% of the grant granted).

This project will be created, where you only have to fill in, sign and attach the Model of Application of the entity benefiting from the assistance aid.

5. PROVISIONAL DISCLOSURE OF THE AMOUNT, by the Commissioner: Once the entity has submitted all its projects, including the assistance and the submission deadline is closed. The Commissioner will complete the review and notification of the resolutions of these projects. At that time, the amount that will be provisionally assigned and retained by the entity for assistance will be calculated, through the following maximum limits:

-3.5% of the amount allocated to projects.

-3.5% of the grant granted.

-The amount requested by the entity for that project.

6. These projects are exempt from the communication of the award, They will go straight to the justification phase.

7. JUSTIFICATION, by the entity: The justification must be submitted within three months of the date on which the deadline expires for the beneficiary entity to submit the last of the justifications for its funded projects.

The expenses must have been executed and paid in the period between the date of publication of the grant award resolution in the “Official State Gazette” and the three months following the date on which the deadline for the beneficiary entity to present the last of the justifications of its financed projects expires.

The entity must fill out, sign and attach the Model of Report Explanatory intervention of the expenses of assistance.

8. CALCULATION OF THE FINAL AMOUNT, by the Commissioner: When the last project of the entity is justified, at that time, the liquidation of the projects presented by the entity will be carried out and the maximum amount to which the aid of the assistance may amount will be obtained, with the following limits:

·3.5% on eligible expenses that would have been duly justified.

·3.5% of the grant awarded

·The amount requested by the entity for that project.

·The duly justified amount of the assistance project.

In order to facilitate the correct execution and justification of the aid regulated by Order TMD/101/2025, it is reported that the application ALBA‑DANA allows to present projects indicating that the total estimated cost of the recovery works is 0 euros (projects to 0).

In these cases, the actual amount of the action will be included in the valued memory, and this amount can be validated as eligible cost, even if there is no subsidy assigned to the project. Therefore, in the valued memory, the amount of the work will be specified, so that the entities once they have consumed the grant granted may have more eligible cost.

What is the purpose of this eligible cost? A dual purpose:

1) Compensate for possible decreases in the amount allocated in the different phases

When the last justification of the submitted projects is reviewed, all the projects submitted by the entity will be finalized and a final resolution of liquidation will be issued.

In the liquidation, compensation will be made between all the projects submitted by the institution, i.e. if a project justifies more eligible expenditure than the allocated subsidy, by means of the acceptance resolution of the submission phase, this excess, together with the eligible cost validated in Projects 0, provided that it is correctly justified, can be used to compensate other projects that have not consumed all of the allocated subsidy due to tender losses, etc.

Therefore, in order for compensation to be made, the amount of the grant granted must be allocated to projects at the submission stage.

Also, in case of submitting project to 0, in order to increase the eligible cost to compensate possible losses, etc. It should be noted that this validation of the eligible cost does not entail the allocation of a subsidy. Consequently, the cost of implementing the project in its entirety must be assumed regardless of whether they can be financed through this aid in the end and in the liquidation in case of possible casualties this eligible cost will be compensated.

2) In accordance with the fourteenth paragraph of Order TMD 101/2025, justify the amount generated with the interest that may accrue from the subsidy received up to the time of the expenditure.

Also, through the projects to 0, eligible actions can be presented whose eligible cost can absorb these interests.

In the case of entities that are not deriving interest, after receiving this email, you must send the attached model, signed by intervention through the General Electronic Registry to DIR EA0056568 - Office for Coordination and Promotion of the Execution of Aid (belonging to Commissioner DANA)

In the case of entities that are accruing interest. Projects will be presented at 0, which may include estimates of the amount of interest earned up to the time of expenditure.

When the generation of accrual interest is completed, the attached model will be presented, signed by intervention through the General Electronic Registry to DIR EA0056568 - Office for Coordination and Promotion of the Execution of Aid (belonging to Commissioner DANA)

When the final settlement decision of the institution is made, it will indicate, among other data, the total amount granted plus, where applicable, the amount of interest accrued, the total eligible cost justified and whether it has to make any repayment.

Guidelines for submitting projects to 0:

-These projects have the same characteristics as the other projects under construction in terms of submission time, award procedure and justification.

- When do they show up?

The following will be presented:

1. Before the end of the submission deadline.

2.Una after submission of the last project using the amount of grant awarded

In this last project of work presented with the final remnant of the amount of the grant granted, it is valid that a greater amount is presented to the remaining remnant of the grant. In that case, if the expense is eligible, it will be indicated which part of the expense is computed as assigned amount of the grant and the rest will be validated as eligible cost.

- How to fill them out in Alba-Dana?

o Title: indicate before the work title: “Eligible cost: (Name of the project)”

o Indicated as Expected Total Cost of Recovery Works: 0 euros. The amount requested for this project will be indicated in the included valued report.

-When it is reviewed, it will be issued ex officio indicating: amount allocated from the grant 0 euros and in the amount of eligible cost validated, the figure that is validated.

- These projects, like the rest, must be submitted in time, the data of allocation and justification.

We inform you that the work of monitoring and control of the actions subsidized in the framework of Order TMD/101/2025, of January 31, will begin.

These tasks are intended verify the correct material execution of the actions, the proper application of the public funds granted and the conformity of the actions executed with the conditions established in the concession resolution and in the regulations governing subsidies.

To carry out this task, Tragsatec has been authorized as its own personified medium established in Additional Provision 24th of Law 9/2017, of November 8, on Public Sector Contracts.

For the effective fulfillment of these functions, it is necessary to have information regarding the current state of the actions subsidized by Order TMD/101/2025. Likewise, in order to facilitate the traceability and control of the files, it is required that, in the Public Sector Contracting Platform, all the files relating to actions subsidised by the aforementioned Order TMD/101/2025, be identified in the title with the following keyword: DANA2024.

It is reported that, within the framework of Order TMD/101/2025, of January 31, may be requested Changes to the amount of the project, in the event that the file is in the submission phase or in the award phase, status: Pending award by EB, through the functionality of Generic Instance of the ALBA‑DANA application, provided that the object of the project initially submitted and accepted is not altered in any way.

These modifications may only relate to:

  • Price reviews or duly justified measurements.
  • Inclusion of expenses necessary for the proper execution of the project (e.g. technical fees, voluntary management, health and safety coordination, etc. ), where such expenses are part of the eligible cost and have been omitted from the initial valued memory.

In these cases, the entity must provide a explanatory report, signed by the competent technician and by the representative of the local entity, which details:

  • El amount whose modification is requested.

  • La technical and economic justification corresponding.

1) FORM OF PRESENTATION OF THE JUSTIFICATION, according to the apart. Seventeenth of Order TMD 101/2025, through the completion of the justification form enabled for this purpose.

  • As indicated in point 7.1.5 of the manual, the justification requires two signatures:

1. Secretary/a.

2. Representative of the Local Beneficiary Entity.

Consequently, it is necessary that in the event that the figure of Secretary is registered in ALBA-DANA2024, they indicate to us by email, to the mailbox: processingn.dana@correo.gob.es that such person is assigned to the role of secretary.

In the event that this figure is not registered as a user, or changes at the time of justification, you must request its registration through the form that you can download from the following link: Model request for configuration of user and mailbox data in the application AlbaDana.pdf which must be sent to DIR EA0056568 - Office for the Coordination and Promotion of the Execution of Aid (belonging to Commissioner DANA), through the General Electronic Register the following completed and signed model.

2) Documentation to be provided together with the justification form.

In the justification phase, in addition to completing the information requested in the justification form and the checks that must be clicked on the certification of the secretary and the representative of the entity, 3 documents must be provided:

I. Representative photographic report of the respective infrastructures, equipment or facilities and services, Obtained after receiving the work

II. Report issued by the intervention of the local beneficiary entity, which accredits the veracity and regularity of the documentation justifying the grant. The report must be signed by the person holding the post of Intervention of the local entity.

III. In the case of indirect management, an update of the declaration of aid received by the managing body must be accompanied (equivalent to what was described for the presentation phase, but referring, of course, to the updated state of aid).

3) Communication of the validation of the Total Cost validated in the Justification phase, by the Commissioner.

The commissioner will review the information received and, where appropriate, issue a letter with the validation, which will reflect the total cost validated in the Justification phase.

In the event that the total cost validated in the Project Justification phase is higher than the maximum subsidy allocated to the project, the difference between the two amounts will be considered as an additional eligible cost. This additional eligible cost may be used, where applicable, for compensation or to absorb accrued interest.

In the final settlement made to the institution, the additional eligible cost may be offset by losses in the amount justified for other projects or by the amount generated by accrued interest. In order to be eligible for compensation, the amount of the grant awarded must be allocated to projects at the submission stage.

4) TERM OF EXECUTION OF THE WORKS.

As indicated in the Sixteenth section of Order TMD 101/2025: “Deadline for projects. The works must be completed within a maximum period of twenty-four months from the date on which the Commissioner has validated in the application “ALBA-DANA2024” the integrity and consistency of the communication of the award of the works indicated in the previous section. In the case of minor contracts, the term of execution may not exceed the term provided in article 29 of Law 9/2017, of 8 November.

  • Extension of the implementation period: In contracts that are not minor, as reflected in point 2b of the Eighteenth paragraph of the aforementioned order, before the end of the current term, please refer to the procedure generic instance of ALBA-DANA2024, job with motivated request for an extension which may be at most 24 additional months.

5) DEADLINE FOR SUBMISSION OF THE JUSTIFICATION.

  • According to the seventeenth paragraph of Order TMD/101/2025, “within three months of the end of the project implementation period The beneficiary entities will present, through the application ALBA‑DANA2024, the Corresponding supporting documentation.”
  • Extension of the deadline for submission of the justification form: as reflected in point 2c of paragraph Eighteenth of the said order, before the deadline, please refer to the procedure generic instance of ALBA-DANA2024, job with motivated request for an extension which may be at most 2 months.

In relation to the email sent on June 8 with subject: Phase of justification. Error has been detected in one of the indicated links, then the correct one is indicated:

“In the event that this figure is not registered as a user, or changes at the time of justification, you must request its registration through the form that you can download from the following link:

Model data users ALBA that the following completed and signed model must be sent to DIR EA0056568 - Office for the Coordination and Promotion of the Execution of Aid (belonging to Commissioner DANA), through the General Electronic Register.”

In addition, the following clarifications have been made to the consultations received:

1) In relation to the report of the intervention to be presented for the justification:

Question 1.1 Is the reporting model an orientation and can it be adapted or should it be literal?

Answer 1.1: It must be literal

Question 1.2. In the case of emergency works, for which deadlines, procedure, etc. Are they different, can you make the intervention your own model by adapting it? Or should "disagreement" be indicated in the existing model and explained as "observations"?

Answer 1.2: In the case of emergency works, the model of intervention available can be used indicating “Satisfied” and in “Observations” add or accredit the regularity of the proceedings pursuant to article 120 of the LCSP, so that it is adequately accredited that the file is legally well processed under the exceptional emergency regime.

In the event that a point is indicated as dissatisfied, the report would not be favourable and could not be validated.

2) Justification period:

Question 2 : In the event that the works are completed and the Act of Reception of Conformity is formalized before the maximum period of twenty-four months is exhausted: Will the date of the Receipt Act mark the automatic start of the deadline for the presentation of the supporting account, or is the general maturity of the file maintained?

Answer 2: In the sixteenth section. Deadline for implementation of GTMD 101/2025 projects: The works must be completed within a maximum period of twenty-four months from the date on which the Commissioner has validated in the application “ALBA-DANA2024” the integrity and consistency of the communication of the award of the works indicated in the previous section. In the case of minor contracts, the term of execution may not exceed the term provided in article 29 of Law 9/2017, of 8 November.

Therefore, the project execution period can be a maximum of 24 months, from the date of validation of the communication commissioner of the project award. With the exception of minor contracts defined in the first paragraph of Article 118 that may not last more than one year.

In the section Seventeenth. Justification. TMD 101/2025, point 1 of which states: Within three months of the end of the project implementation period, the beneficiary entities will submit, through the application “ALBA-DANA2024”, the supporting documentation of the project.

Accordingly, Completion of the project implementation period, indicated in the seventeenth section of the order, refers to the maximum 24 months or 12 months in case of minor contracts, which begin when the award is validated by the commissioner and not the date of the receipt of the contract for the work.
