Project of Royal Decree regulating the direct granting of a subsidy to the Spanish Federation of Municipalities and Provinces for the financing of the operating expenses of its activity (2026)

In accordance with the provisions of article 133 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations and article 26.2 of 50/1997, of 27 November, of the Government, the present consultation aims to obtain the opinion of the people potentially affected by the future rule and of the most representative organizations, on the following aspects:
Given its institutional status, its legal nature and its work on behalf of local entities, there is a long tradition of cooperation between the Spanish Federation of Municipalities and Provinces (FEMP) and the different ministerial departments and, in particular, with the current Ministry of Territorial Policy and Democratic Memory, which, by virtue of Royal Decree 273/2024 of 19 March, which develops its basic organic structure, is responsible, among other functions, for relations and collaboration with local entities, directly or through their associations, in matters of local government and administration.
To enable the FEMP to carry out its work of cooperation and representation of the interests of local governments in various fields under appropriate conditions.
Considering that the aforementioned objectives remain fully valid, the General Administration of the State wishes to renew its commitment to continue cooperating in the financing of the work of the FEMP in representation and defense of the interests of local governments.
There are reasons of public and social interest that motivate and justify the direct granting of a subsidy to the FEMP with the object and purpose included in the projected norm, given that it is the association that represents the largest number of local entities, meeting the aforementioned requirements in defense of the interests of local governments and the highest institutional representation of them, which justifies the economic cooperation of the State with the aforementioned Public Utility Association, without there being the option of resorting to a competitive concurrence procedure due to the lack of such concurrence.
Approve the special regulations governing a grant, to be granted by direct concession, from the General Administration of the State, through the Ministry of Territorial Policy, to the FEMP, for the financing of the operating expenses of its activity carried out during the financial year 2026.
It has been assessed that there is no alternative that is more suitable than the one chosen. In this regard, in accordance with the provisions of article 28.2 of Law 38/2003, of 17 November, General Subsidies, the special regulations governing subsidies provided for in article 22.2.c) of this regulation must be approved by royal decree, on the proposal of the person in charge of the competent Ministry and after a report from the Ministry of Finance.
Based on the above considerations, a period of prior public consultation on the possible content of the planned royal decree is opened.
Duration of the consultation: 15 natural days. It ends on May 7, 2026.
