In order to provide the interested parties with the tasks of location of people victims of the Spanish War and the Franco Dictatorship referred to in Law 20/2022, of October 19, of Democratic Memory, we put at your disposal the following tools (the information will be progressively overturned, please excuse the inconvenience):

With regard to archives, we recall that Article 27 of the Democratic Memory Act, guarantees the right to free and universal access to public and private archives, as well as the consultation of historical documents forming part of documentary series or collections of assets of the Documentary Heritage on the coup d'état, the war, the Franco dictatorship, the anti-Franco guerrilla resistance, the exile, the internment of Spaniards in concentration camps during the Second World War and on the transition until the entry into force of the 1978 Constitution, regardless of the type of archive in which they are kept.

Any person will have the right to consult in full the information existing in the documents that prove or may prove their status as victims, also being able to consult the personal data of third parties that may appear in said documents regardless of the date of the same. These persons shall have the right to obtain a copy, free of fees, of all the documents in which they are mentioned and which they are going to incorporate into the procedure of declaration of recognition and personal reparation contemplated in article 6 of this law, as well as for any other claim of reparation to which they were entitled.

The consultation of the documents on the coup, the war and the dictatorship generated and gathered by the different ministerial departments of the General State Administration and other entities of the state public sector, regardless of the public administration or the institution that manages them, is governed by the provisions of article 57 of Law 16/1985, of June 25, and the regulatory rules that regulate the Archives System of the General State Administration and its Public Agencies and its access regime.

The documents of the Administration of Justice and of the judicial archives on the coup d’état, the war and the dictatorship, once they fulfilled their function at the disposal of the corresponding jurisdictional body for having concluded the procedure, have the status of property of the State documentary heritage and their consultation is also governed by the provisions indicated in the previous section.

The provisions of the preceding paragraphs shall apply, where appropriate, to private archives held, in whole or in part, by public funds, in accordance with the laws and regulations that regulate access to documents of privately owned archives and apply to centres of this nature in the Archival Systems of the Autonomous Communities that correspond in each case, or in the Spanish System of Archives.

The general right of access to documents in archives includes both direct access to the documents in question and the right to obtain copies and certificates thereof. Within the scope of the competences of the General Administration of the State, the realization of autocopies or obtaining electronic copies in the development of research works will not be subject to any type of fee, canon or levy.

Finally, it is important to point out, with a view to free, universal and free access to the consultation and reproduction of the documentation safeguarding the files referred to in article 27 of the Democratic Memory Act, that the relatives of the persons who suffered some of the circumstances set forth in article 27 shall be considered victims. 3.1, meaning the person who has been the spouse of the victim or person linked by a similar relationship of affectivity, their descendants, their ascendants and their collaterals up to the fourth grade. In case of controversy in the exercise of the actions provided for in this law, preference will be given to anyone who has been the spouse of the victim or a person linked by a similar relationship of affectivity. In the event of the death of the victim, the descendants in order of their greater proximity to the victim will have preference over the relatives in the collateral line, whose preference will be established in order of their greater proximity.
