In operation the office for the care of victims and relatives of deaths in railway accidents of the Government Delegation in Madrid

The Delegation of the Government of Spain in the Community of Madrid has launched the office of care for victims and relatives of deaths in the railway accidents of Adamuz and Gelida where information, accompaniment and administrative support is provided in the processing of aid dependent on the General Administration of the State, including those of the Royal Decree-Law establishing compensation.

In this way, it is intended to provide assistance and resolve the doubts related to the procedures to be carried out with the state agencies of all those affected who reside in the region and avoid unnecessary displacements. An appeal that has been reported from the Government Delegation by letter to the relatives of the deceased in Madrid.

Likewise, these offices have been created in other delegations and subdelegations of the Government, mainly in Andalusia.

Face-to-face, telephone and electronic care

Family members of the deceased and injured persons may contact the Government Delegation, call or email both to make their inquiries and to request an appointment. In the event that the person cannot travel or has difficulty in doing so, the service of the ‘Administration near you’ will move to its location. Each person will always be attended by the same staff to ensure maximum individualized attention and adjusted to their personal circumstances.

Royal Decree-Law

El Royal Decree-Law 1/2026, of 27 January, on aid for victims of rail accidents in Adamuz (Córdoba) and Gelida (Barcelona) regulates the extraordinary aid that the Government of Spain has agreed, amounting to 20 million euros, in order to quickly meet the needs of the people affected. Of these 20 M€, 10 M€ are allocated to direct aid and another 10 M€ as an advance payment for insurance indemnities, within the framework of civil liability insurance.

These aids will be compatible with the indemnities of compulsory insurance and civil liability, and will be exempt from taxation. In addition, they will be paid in a single payment in the form of immediate assistance to victims and advance compensation for accident insurance.

These are measures of an economic nature to speed up the receipt of aid by those affected, advance part of the compensation corresponding to the civil liability insurance and thus avoid the waiting times inherent in the ordinary insurance procedures.

This aid will be in addition to the mechanisms already existing in the current legal system and will be complementary to the plans, insurance and coverage provided by law for victims of railway accidents and, therefore, compatible with mandatory civil liability compensation. In addition, they will be received in full since they will be exempt from taxation.

The amount to be received has been defined as follows:

• In cases of death, a direct aid of just over 72,000 euros for each deceased person and the same amount as an insurance advance.

• In cases of bodily injury, the aid is structured by levels of severity, with amounts ranging from slightly more than 2,400 euros in cases of minor entity to more than 84,000 euros in cases of maximum severity. The figures are the same for the insurance advance.

Complementarily, the normative modifications will be initiated for the future implementation of this type of measures in the Spanish legal system, in order to articulate a structural mechanism of public intervention so that the State assumes in advance the payment of a percentage of the compensation corresponding to the personal damages derived from collective transport accidents, without prejudice to the subsequent determination of the civil liability of the natural or legal persons responsible for such accident.
