Basic data on the activity of the Bilateral Cooperation Commissions from 1984 to the present are provided.
Article 33 of Organic Law 2/1979, of 3 October, of the Constitutional Court, in the wording given by Organic Law 1/2000, of 7 January, has given the Bilateral Cooperation Commissions a new role, allowing them to adopt agreements for the resolution of discrepancies that prevent, where appropriate, the lodging of an appeal for unconstitutionality. To this end, the Bilateral Cooperation Commissions have adopted a specific operating mechanism in the case provided for in article 33 of Organic Law 2/1979 of 3 October 1979. Likewise, this function of resolving disputes of any kind raised between the State and Autonomous Administrations has been consolidated in the Statutes of Autonomy approved in 2006, 2007 and 2018.
It is therefore necessary to distinguish the following types of meetings of the Bilateral Cooperation Commissions according to their purpose:
- Those aimed solely and exclusively at regulatory follow-up, conflict prevention and conflict resolution, which, since the adoption of Organic Law 1/2000 of 7 January, began to be subject to a unique system of operation in compliance with the provisions of article 33 of Organic Law 2/1979 of 3 October.
- Meetings of a general nature, as an ordinary and permanent framework for relations between the Governments of Spain and each Autonomous Community, to learn about and deal with issues of common interest established by law or raised by the parties, without prejudice to the fact that they have also been able to address, in part, issues of conflict.
In view of the above, it is appropriate to collect information, in a manner that is syngularized according to its purpose, on the meetings held of the Bilateral Cooperation Commissions. However, it is noted that the data on the meetings convened according to the procedure contemplated in article 33 of Organic Law 2/1979, of October 3, only to resolve the disputes raised between the State and the Autonomous Communities is contained both in the Monthly Reports of Conflict and in the Quarterly Bulletins of Conflict between the State and the Autonomous Communities (/content/mpt/es/politica-territorial/autonica_juridico.html).
