- Inform and advise those responsible and in charge of the processing of personal data, as well as the employees who deal with it, of the obligations that correspond to them, in accordance with the GDPR , the LOPDGDD and other relevant provisions.
- Supervise compliance with the provisions of the regulations and policies of data controllers and data processors in the field of data protection.
- Offer advice that is requested regarding the impact assessment regarding the protection of personal data.
- Cooperate with the Spanish Data Protection Agency and act as a contact body with it.
- Intervene in the event that the interested parties present to him the potestative claim prior to the claim before the AEPD.
- To attend to the issues of the interested parties regarding the processing of their personal data and the exercise of their rights, under the protection of the GDPR and of LOPDGDD .
Data Protection
FUNCTIONS OF THE DATA PROTECTION OFFICER
Articles 34.1 of the Organic Law 3/2018, of 5 December , of Protection of Personal Data and Guarantee of Digital Rights (hereinafter, LOPDGDD), and 37.1 of Regulation (EU) 2016/679 of 27 April (hereinafter GDPR), force to designate a Data Protection Officer when the treatment of them is carried out by a public authority or body.
According to Article 10.2(c) of the Royal Decree 273/2024, of 19 March , which develops the basic organizational structure of the Ministry of Territorial Policy and Democratic Memory, it is the responsibility of the Sub-Directorate General of Resources, Publications and Documentation to “coordinate and supervise data protection policy in compliance with the applicable regulations in this field within the scope of the competences of the Department and, in particular, to exercise the competences related to the data protection delegate, provided for in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 for the scope of the Ministry, excluding its Public Agencies.”
In compliance with the above, the functions of Data Protection, excluding autonomous bodies, are exercised by the aforementioned Subdirectorate General.
