As of June 18, 2016, it has been published in the Official State Gazette of the Resolution of June 15 by the General Secretariat for Immigration and Emigration, which publishes the Agreement of the Council of Ministers, approving the instructions determining the procedure for authorising the temporary residence of minors and the stay of monitors, of Saharawi origin, in Spain within the framework of the ‘Holidays in Peace 2016’ Programme.

Request for Prior Report for Temporary Displacement of Foreign Minors (EX-14)

This solidarity programme allows Spanish families to receive, on a temporary basis, children from the Saharawi refugee camps located in the province of Tindouf, and gives thousands of children the opportunity to enjoy a summer holiday in Spain and then return to their places of origin.

For this year, the arrival of 4,570 minors is planned, accompanied by 205 monitors, who will be hosted in Spain for two months.

The Sub-Ministers of the Government and the Government Delegates in the Autonomous Uniprovincial Communities are competent to give the report in favour of issuing temporary residence permits to children travelling within the framework of this programme.

Like novelty in 2016 and in order to comply with the provisions of Law 26/2015 of July 28 (B.O.E of 29), It is necessary that the interested parties provide a negative certification of criminal records for sexual crimes relative to the elderly members of the specific family with which the minor is going to live during his stay in Spain.

In order to facilitate this procedure to the interested parties, two systems have been put into operation by the Ministry of Finance and Public Administration:

• You can submit with the consent of the elderly members of the specific family in the request for a report with which the minor will live during his stay in Spain, so that the Government Delegations or Sub-Delegations can obtain the corresponding certifications directly either individually or through mass requests, through the Data Intermediation Platform of the Ministry of Finance and Public Administrations.

Two models of consent guidance for the persons concerned are given below, one of declaration of older family members and one of declaration of older family members and authorization to prove that there is no history of sexual offences.

• You can obtain the proof of absence of sexual history through Citizen Folder and provide it directly.

It is accessed through the Internet with a digital certificate or through the cl@ve system.

In addition, the Ministry of Justice in its electronic headquarters has made available to citizens the possibility of consult the certificate of the Central Registry of Sex Offenders.
