The Government Delegation in Asturias has learned through social networks and information published in the media of the call by the National Nucleus for a concentration in Oviedo on Sunday, February 23 at 11 a.m., with the aim of commemorating the coup d'état of 23F.
A call that has not been communicated to this Government Delegation despite being a mandatory requirement for holding demonstrations or rallies on the public highway in cases of meetings of more than twenty people. This lack of prior communication violates the current regulations on the fundamental right of assembly and exposes its organizers to the sanctions established in the Law on the Protection of Citizen Security. According to the law regulating the right of assembly, the holding of meetings in places of public transit and demonstrations must be communicated in writing to the governmental authority at least 10 calendar days in advance. When there are extraordinary and serious causes that justify the urgency of the convocation, it may be done at least 24 hours in advance.
Faced with this situation, the Government Delegation has already given the appropriate instructions to the State Security Forces and Bodies to ensure compliance with current legislation, especially the Democratic Memory Act, which establishes mechanisms to sanction any act that involves the exaltation of dictatorship or the humiliation of its victims.
Likewise, the Government Delegation would like to recall that Spanish legislation provides for strong measures against hate crimes. Any conduct that incites discrimination, violence or intolerance will be investigated and, where appropriate, punished accordingly. Security, coexistence and respect for democracy are inalienable principles in our rule of law.
In this regard, the Government Delegation will not tolerate any alteration of public order, non-compliance with the Democratic Memory Act or the Citizen Security Protection Act, or the commission of hate crimes. All necessary measures will be taken to ensure compliance with the law and the protection of the rights of citizens.
