- For the Government Delegation, this equalization constitutes a clear violation of the Law of Recognition and Integral Protection of Victims of Terrorism
The Government Delegation in the Basque Country has requested the municipalities of Galdakao, Orio, Oiarztun, Hernani, Amasa-Villabona and Azpeitia to remove from their memory websites the equalization they make between victims and members of ETA. In these websites, the members of ETA are compared with those killed by the terrorist group, considering that they “suffered violations of rights” and their stay in prison as a result of sentences imposed by the courts of a democratic State and of law is defined as “captivity”, which is an attempt to describe as victims those who have been the object of the legitimate action of the Public Authorities against terrorism.
This request is made after studying and verifying the existence of this homologation by the State Attorney in the Basque Country in recent days. On the other hand, it has also been verified that the municipalities of Erandio and Tolosa that have a similar website have given instructions to deactivate them.
This equalization constitutes a clear violation of article 61 of Law 29/2011, of September 22, on the Recognition and Integral Protection of Victims of Terrorism.
Therefore, the Government Delegation requests these municipalities to withdraw, within a maximum period of one month from receiving this request, persons belonging to the terrorist group ETA, fugitives from justice or convicted of terrorism if they have entered their names among the so-called victims.
In the event of failure to comply with this request, the State Attorney will take the appropriate actions to achieve its due compliance.
