The Government allocates 22.8 million to Castilla y León for distribution in programs of general interest related to the third sector
The BOE has published the agreement of the Territorial Council of Social Services and the System for Autonomy and Attention to Dependency
November 22, 2023.- The Government of Spain will allocate 22.8 million euros to Castilla y León for distribution among third sector entities that develop social programs of general interest. The subsidy is made from the tax allocation of 0.7% of Personal Income Tax and Corporate Tax.
The Official State Gazette has published the resolution of the Secretary of State for Social Rights under the Ministry of Social Rights, Consumption and Agenda 2030 that publicizes the agreement of the Territorial Council of Social Services and the System for Autonomy and Attention to the Unit. This agreement establishes the distribution of 295 million euros between the autonomous communities and cities with autonomous status. Castile and Leon are entitled to 22,867,120 euros.
These grants are intended to carry out programs of general interest to serve purposes of social interest, under the tax allocation of the Personal Income Tax and the Corporation Tax to be managed by the autonomous communities and cities with autonomous status.
The grants will be intended to cover the specific needs of social assistance aimed at the care of people in situations of poverty and social exclusion or who are in other situations of special vulnerability, a competence statutorily assumed as exclusive by the autonomous communities and cities with autonomous status.
The entities of the Third Sector of Social Action defined in article 2 of Law 43/2015 of the Third Sector of Social Action, the Spanish Red Cross, will be considered as beneficiary entities, as well as those contemplated as entities of the Third Sector of Social Action in the specific legislation of the autonomous communities and cities with autonomous status.
The ordinary procedure for awarding grants shall be conducted on a competitive basis. The autonomous communities and cities with autonomous status will be responsible for establishing the regulatory bases of these subsidies, the convening, processing and resolution of the concession procedures as well as the payment of the aid, its justification regime and the processing of the reimbursement and sanction procedures.
REQUIREMENTS TO BE MET
The Spanish Red Cross and the entities of the Third Sector of Social Action will be able to access the status of beneficiaries of the subsidies as long as they meet some requirements. Among them, to be legally constituted and, where appropriate, duly registered in the corresponding administrative register, or to have submitted their application for registration, within the deadline for submission of grant applications, in the terms provided for in the regional regulations of application; to be unprofitable; to be current in the fulfilment of tax obligations, with Social Security and by repayment of grants, imposed by the current provisions; to demonstrate experience and specialization in the care of the collective or groups to which the programs are directed; to carry out their activities in a real and effective manner within the scope of the autonomous communities and cities and to be legally constituted at least two years before the grant is issued,
Within the limits of regional legislation, groups of organizations without legal personality may also benefit from these subsidies. They shall not be understood as included within the typology of these entities of the Third Sector of Social Action, the bodies or entities of public law attached or linked to a Public Administration, the universities, the political parties and the foundations of which they are dependent, the professional associations, the official chambers of commerce, industry and navigation, civil societies, business organizations and trade unions, and other entities with similar specific purposes and nature to those cited above.
The allocation of grants will take into account a series of guiding criteria such as implementation in the autonomous community, the programs carried out by that entity, as well as the number of affiliated partners; that the structure of the entity is adequate to manage the programs presented and the quality of management and that such management is subject to periodic controls or that the entity promotes participation and social mobilization, among other aspects.
