The Government Delegation in Madrid has today issued a resolution prohibiting the concentration convened by the National Nucleus Association for June 7 in front of the First Reception Center of Hortaleza.
This decision responds to the need to protect public safety and the fundamental rights of children placed in the centre, in application of the principle of the best interests of the child. It therefore prioritizes the protection of minors residing and tutored in this centre against harassment and hatred by the ultras.
The concentration reported was based on messages and slogans of a xenophobic and exclusionary nature, directed specifically against resident minors, including unaccompanied foreign minors.
The reports collected warn of the risk of disruption of public order and the possibility of incurring a hate crime. It is worth recalling the incidents provoked by the conveners, the National Nucleus, in addition to their threatening, hateful and racially charged speeches about these minors.
Likewise, it is considered that the chosen place – the immediate vicinity of the center, which constitutes the habitual domicile of minors – would violate their right to privacy and a safe environment, as established by Organic Law 8/2021 on the integral protection of children and adolescents against violence.
The Government Delegation recalls that the exercise of the right of assembly does not protect concentrations that imply harassment or discriminatory targeting of vulnerable groups, nor that generate risk for the coexistence or integrity of individuals.
The law allows a demonstration to be prohibited if it is reasonably believed that there are indications that it may constitute a crime or generate disturbances of public order, with danger to persons or property.
The protection of the rights of the child and the prevention of all types of violence are a priority obligation of the public authorities.
