The data subject shall have the right, in a structured, commonly used, machine-readable and interoperable format, to receive the personal data concerning him or her, which he or she has provided to a controller, and the right to transmit them to another controller.

The exercise of this right requires two requirements: that the treatment is based on the consent of the interested party and that such treatment is carried out by automated means.

Therefore, this right is not recognized to the interested party when the treatment is necessary for the fulfillment of a legal obligation, a mission of public interest or in the exercise of public powers conferred to the person responsible for it.
