Prior public consultation on the "Preliminary Draft Law on the Prevention of Conflicts of Interest of Personnel in the Service of the Public Sector"

In accordance with the provisions of article 133 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations, in relation to article 26.2 of Law 50/1997, of 27 November, of the Government, with the aim of improving the participation of citizens in the procedure of elaboration of rules, a public consultation on the preliminary draft Law of Prevention of Conflicts of Interest of personnel in the service of the public sector is elaborated.
In accordance with the provisions of the Agreement of the Council of Ministers, of 30 September 2016, issuing instructions to enable public participation in the process of normative elaboration through the web portals of the ministerial departments, published by Order PRE/1590/2016, of 3 October, citizens, organizations and associations that consider it can send their opinions on the aspects raised in the consultation, during the period of one month, which for the present case will be open until 28 May 2021, through the following e-mail: secretaria.oci@correo.gob.es.
In the written pleadings submitted, it will be necessary to state the following:
- Name and surname and/or social name of the natural or legal person who subscribes to the claims, as well as the full name of the participating organization or association, where applicable.
- Contact details, and among them, uniquely the email address.
- Clear indication in the “subject” field of the email that the statement of allegation refers to the public consultation of this Preliminary Draft.
Finally, it is noted that only those writings of allegations in which the sender is identified will be taken into consideration.
In general, the contributions received will be considered to be open to public dissemination. The parts of the information submitted that, in the opinion of the persons concerned, should be treated confidentially and, consequently, should not be freely disseminated, should be specifically indicated in the text of the contribution itself, not considering for this purpose the generic messages of confidentiality of the information.
Law 53/1984, of December 26, on Incompatibilities of Personnel in the Service of Public Administrations, which regulates the system of compatibilities of employees in the service of Public Administrations.
The years since the entry into force of Law 53/1984, of December 26, have highlighted the need to modify some of its precepts to adapt them to the requirements of the current, more demanding Administration, as well as to establish a system of prevention and management of conflicts of interest that is not exclusively aimed at the limitations applicable to the performance of a second activity. On the other hand, the emergence of new forms of provision of professional activities requires a regulation that specifically covers them. It is also intended to comply with the recommendations of the Group of States against Corruption of the Council of Europe (GRECO) regarding the promotion of public integrity.
In addition to the time that has elapsed since the entry into force of Law 53/1984, of 26 December, and the need to establish new systems of prevention and management of conflicts of interest in public administrations, the Fourth Open Government Plan (Integrity Axis) has included the modification of the current regime of incompatibilities, in order to establish a new framework of action more in line with the current demands of society.
On the other hand, the modification of this regulation is a demand that has been arising in different sectors of the Public Administrations.
- Establish a new system for the prevention of conflicts of interest and incompatibilities of public sector employees.
- Regulate the performance of new forms of provision of professional activities that are not contemplated in the current regulations.
- Establish a new regulation of the activities exempted from the regime of incompatibilities.
- Establish limitations on the performance of private activities in cases of administrative situations other than active service.
- Establish a new and more rigorous system of conflict of interest prevention for contingent personnel.
They are not contemplated, since the regime of incompatibilities is regulated in a basic law so that its modification requires the same treatment.
1. Con carácter general.
- ¿Considera que las limitaciones establecidas en la actual Ley 53/1984, de 26 de diciembre, de Incompatibilidades del Personal al Servicio de las Administraciones Públicas son adecuadas para garantizar la integridad, imparcialidad e independencia de los empleados públicos?
- ¿Cree que deberían establecerse limitaciones adicionales?
2. Incompatibilidad con segunda actividad pública.
- ¿Considera que el actual régimen de limitaciones con actividades públicas es el adecuado?
- ¿Considera que se debería posibilitar, en determinados supuestos la compatibilidad con una segunda actividad pública, para puestos con inferior nivel de responsabilidad y siempre que no hubiera merma de las obligaciones de ambos puestos?
3. Incompatibilidad con actividad privada.
- ¿Considera que el actual sistema de limitación de actividades privadas cumple con su objetivo de evitar actividades privadas que colisionen con el puesto público?
- ¿Cree que se debería sustituir la regla actual del artículo 16 de la Ley 53/1984, de 26 de diciembre, de Incompatibilidades del Personal al Servicio de las Administraciones Públicas por otra?
5. Actividades exceptuadas
- ¿Considera que el actual artículo 19 contempla todas aquellas actividades que tienen que estar exentas de reconocimiento de compatibilidad?
6. Personal eventual.
- ¿Considera que el personal eventual debe estar sujeto a las mismas normas de prevención de conflictos de intereses de los altos cargos?
- ¿Considera que deben ser objeto de publicidad activa el currículum vítae, las funciones y las retribuciones del personal eventual?
7. Incompatibilidades al cese
- ¿Considera que deben establecerse limitaciones para el ejercicio de actividades privadas en el supuesto del personal no alto cargo que pasa a situaciones de excedencia o jubilación?
8. Finalmente, ¿qué otras cuestiones considera que se deberían contemplar en el anteproyecto para reforzar la prevención de conflictos de intereses del personal al servicio del sector público?
