In order to mitigate the personal and material damage produced, in accordance with the provisions of article 24 of Law 17/2015, of 9 July, and other applicable legal and regulatory provisions, the measures referred to in the following paragraphs will be adopted.

Third. Damage to municipal infrastructures and the provincial and insular road network.

To the projects directly related to the claims referred to in the first section of this agreement that are executed by the municipalities, the island councils, the provincial deputies or the uniprovincial autonomous communities, the counties and the communes in the municipal terms and population centers, related to the works of repair or restitution of infrastructures, equipment or facilities and services of municipal ownership included in the article 25.2 of the Law 7/1985, of 2 April, Regulating the Bases of the Local Regime, and of the road network of the provincial deputies, of the island councils

(BOE 23/10/2024) Resolution of 9 October 2024 of the State Secretariat for Territorial Policyon the allocation of subsidies for the recovery of damage to municipal infrastructure and the provincial and island road network, provided for in the Agreement of the Council of Ministers of 25 September 2023 declaring the territory affected as a result of various episodes of forest fires and adverse weather events to be 'an area seriously affected by a civil protection emergency'.

Note for entities with funded projects:

No later than three months after the publication of the said resolution in the “Official State Gazette”, the beneficiary entities – provincial councils and administration of the autonomous uniprovincial communities – must submit through the AURA application the award certificate for each of the projects to which a grant has been awarded, in view of the documentation provided to them by the executing entities of the works, as well as an annexed document with information on the contracts awarded.

According to the art. 15 of the basic order, this time limit may be extended. To this end, by Resolution of October 24, 2024, of the General Directorate of Regional and Local Cooperationl It has been agreed to extend, ex officio and for all projects financed, until 10 March 2025, the deadline for the submission of the award certificate.

Such agreement has extended the term by the maximum time allowed by art. 32 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations, so that the aforementioned deadline is no longer subject to further extensions.

The provincial deputies and the administration of the uniprovincial autonomous communities, as beneficiary entities, are empowered to approve instructions specifying the period and form in which the executing entities must send them the information they need to ensure compliance with the obligations derived from Order HAP/196/2015, of 21 January and from the decision to call. This power is expressly provided for in the allocation decision itself (see the second decision).

We would like to remind you that failure to submit the award certificate within the stated time limit will result in the loss of the right to full payment of the subsidy allocated to the project in question (art. 12.4 of Order HAP/196/2015, of 21 January).
