• The art. 124 states that projects for electricity production, transmission and distribution facilities shall be subject to environmental impact assessment, when required by the applicable legislation in this field (art. 36 of Law 21/2013), and for this purpose, the necessary public information according to the previous regulations will be carried out in the phase of administrative authorization.
• Article 125 states that requests for administrative authorizations shall be submitted to the public information procedure within thirty days, for which purpose an announcement shall be inserted in the Official Gazette of the respective province or Official Gazette of the respective Autonomous Community, and also in the Official Gazette of the State. In the event that the installation affects more than one province, it will be appropriate to process the publication of the announcement in the Official State Gazette to the Areas or, where appropriate, Industry and Energy Units in whose province the installation originates. During the aforementioned period of thirty days, the interested parties may make the arguments they deem appropriate.
In the event that an administrative authorisation and a declaration of public utility are simultaneously requested, the public information referred to in the preceding paragraph shall be made in conjunction with that of the declaration of public utility.
• The art. 144 provides that the application for recognition, in particular of public utility, together with the technical and annexed project document accompanying the application for recognition of public utility, shall be submitted to the public information procedure for a period of 30 days.
To this end, a notice containing a specific and individualized list of the property and rights affected by the procedure of forcible expropriation of full ownership or for the imposition of servitude for the passage of electrical energy shall be included in the Official State Gazette and the Official Gazette of the affected provinces. The announcement will also be published in one of the most widely circulated newspapers in each of the affected provinces.
• Finally, the art. 36.1 of Law 21/2013, of environmental assessment, establishes that the promoter will present the project and the environmental impact study to the substantive body, which will submit them to public information for a period of not less than thirty working days, after announcement in the corresponding Official State Gazette or Official Gazette and in its electronic headquarters.
