Project of Royal Decree regulating the direct granting of grants to various entities for activities related to the promotion and dissemination of democratic memory

In accordance with the provisions of article 133 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations and article 26.2 of 50/1997, of 27 November, of the Government, the present consultation aims to obtain the opinion of the people potentially affected by the future rule and of the most representative organizations, on the following aspects:
Royal Decree 273/2024, of 19 March, which develops the basic organizational structure of the Ministry of Territorial Policy and Democratic Memory, determines that this department is responsible for the proposal and execution of the Government's policy on historical and democratic memory.
On the other hand, Law 20/2022, of October 19, on Democratic Memory establishes in its Preamble: “[…] Public policies of democratic memory must capture and channel the aspirations of civil society, encourage citizen participation and social reflection, and repair and recognize the dignity of the victims of all forms of intolerant and fanatical violence. Memory thus becomes a decisive element to promote open, inclusive and pluralistic forms of citizenship, fully aware of its own history, capable of detecting and deactivating the totalitarian or anti-democratic tendencies that grow within it […]”.
Article 43 of Law 20/2022, of 19 October, on Democratic Memory, stipulates that the actions of the General Administration of the State in the field of democratic memory shall be directed to the promotion of democratic values and coexistence, guaranteeing the pedagogical component appropriate to the field in which they are developed. In order to promote the dissemination of values and knowledge of democratic memory, article 48 continues, the planning, organization of activities aimed at the dissemination and knowledge of the main milestones of our democratic history will be promoted.
In order to comply with the above precepts, the Secretary of State for Democratic Memory considers it advisable to contribute to the financing of various projects and activities whose main objective is the promotion of Democratic Memory.
In this sense, memory is presented and claimed as a right of citizenship with a fundamental objective: guarantee of non-repetition or duty of memory. To this end, it is essential to spread the Democratic Memory among the general public and especially among the new generations, so that they know the truth of our recent history and help to ensure that these tragic events do not happen again.
Given the existence of sufficient reasons of public social and humanitarian interest that justify the granting of subsidies directly, in accordance with the provisions of articles 22.2.c) and 28 of Law 38/2003, of 17 November, General of Subsidies, the legal instrument used is determined by law and must take the form of a royal decree.
The main objective of this grant is to contribute financially to the realization of dissemination, promotion and knowledge activities related to the Democratic Memory.
Because it is a material action, the alternative of granting the grant would be the option of not granting it, and it must be concluded that the latter option would not make it possible to meet the defined objectives, nor to carry out the subsidized activities, that is, the promotion and dissemination of the Democratic Memory, and that therefore, the granting of the grant is the most appropriate decision.
Based on the above considerations, a period of prior public consultation on the possible content of the planned royal decree is opened.
Duration of the consultation: 15 natural days. It ends on June 11, 2024.
